This Privacy Policy is where we explain to you what information is collected when you’re browsing and posting on our forums, how it is collected, how we use that information, where we store it, and how we protect it. We will also explain your rights in relation to the information. We've put together both a full text version and a (non-legally binding) summary version to make things easier for our users to understand.

  • 1. WHO WE ARE

  • 1.1. We are rAthena, a non-profit organisation registered in England, United Kingdom with a registered office at 10 Market Street, Kettering, Northants, NN16 0AH.

  • 2. WHAT THIS PRIVACY POLICY GOVERNS

  • 2.1 This Privacy Policy applies to rathena.org, your rAthena user account, any content, avatar, signatures, videos or other content on the forums platform or content which you purchase or use via rathena.org, your account credit, payment methods, the server database, jobs available listings, support tickets and any other services we provide to you (we'll just call all this "rAthena Forums" for short).

    2.2 Specifically, this Privacy Policy governs personal information and non-personal information which we collect from you when you're using the rAthena Forums. ("Personal information" means information which, on its own or in combination with other information, can be used to identify you).

    2.3 We respect your right to privacy and will only process personal information in accordance with applicable data protection legislation in the EU, the USA (including the Children's Online Privacy Protection Act) and elsewhere.

    2.4 rAthena Forums works with trusted partners, developers and publishers, payment providers, customer service software providers and others ("Partners”) – more on them later in this Agreement.

    2.5 For personal information contained in this Privacy Policy which is used by rAthena, rAthena is the data controller under European Union data protection legislation. For personal information contained in this Privacy Policy which is used by our Partners in connection with rAthena, then the relevant partner(s) will be the data controller under European Union data protection legislation.

  • 3. PROTECTING CHILDREN

  • 3.1 We recognise we have a special obligation to protect personal information obtained from children. Legally, children below 13 cannot have an rAthena Forums account (but their parents/guardians are welcome to sign up themselves) and we do not and will not knowingly collect personal information from any child under the age of 13 without consent from their parent or guardian. If you are a parent or guardian and are concerned about the transfer of personal information about your child, please contact [email protected].

  • 4. WHAT INFORMATION WE COLLECT

  • 4.1 When you register an account with us, you will need to provide us: (a) your username; (b) your email address and (c) a password (which is encrypted so that we don’t have access to it). In your account settings you can also set your date of birth and your geographical location. This information is optional and if filled in, will be displayed in posts and/or on your account profile page. You are responsible for keeping your information safe.

    4.2 When you use the rAthena Forums, we may also collect the following information (how we use it is described later in this document):

    • a) Technical details about devices which you use to access rAthena Forums, including: Internet and/or network connection (including your IP address); mobile device identifiers; your operating system, browser type or other software; your hardware details (if available); or other technical details provided by your web browser. This is technical data about our users and their actions and patterns, which does not provide personal information;
    • (b) Details of your use of the rAthena Forums including, but not limited to: metrics information about when and how you use our services (such as which threads you have visited and how long you spend in the download area); traffic data; your geographical location; your purchase history; emails received; and links accessed;
    • (c) Other information required in order to help you with any queries/support you may need assistance with via the forums or customer support; and
    • (d) limited payment processing information, including as applicable your credit card number, name and email address (on a hashed/anonymised basis as applicable).
    • (e) any other information which you supply us via our services;

    4.3 A quick word about payment details (if/when you use them in the rAthena Forums) this is a matter for the relevant payment method/platform/processor. We process only limited payment processing information on a hashed/anonymised basis as applicable with the exception of the user's address where the card/payment account is registered to in order to perform checks via our anti-fraud services. If you make any purchases within the forums, then we are notified by the payment processor once a transaction takes place and of course we make sure you receive your purchased package, but we will not receive any of your actual payment details. 

  • 5. HOW WE COLLECT INFORMATION FROM YOU

  • 5.1 We may collect, process and use information about you in the following ways (either directly or via our Partners as explained above): (a) information you give us via your rAthena Profile; (b) information given when you contact us or report a problem with the forum software itself; and (c) we may also ask you to complete surveys that we use for research purposes, although you don't have to respond to them. We may collect this information via the rAthena Forums or trusted third parties connected with us for optional things like surveys or polls.

  • 7. WHERE WE STORE YOUR INFORMATION

  • 7.1 All information you provide to us is stored on our secure servers or those of our trusted partner services. We implement appropriate technical and organisational measures to protect your personal data against unauthorised or unlawful processing, accidental loss, destruction or damage. Unfortunately, the transmission of information via the Internet is not completely secure. We will do our best to protect your personal information, but we cannot guarantee 100% security of your data transmitted to our servers; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security to prevent unauthorised access to our servers

  • 8. HOW WE USE YOUR INFORMATION

  • 8.1 We will use the above information in the following ways:

    • (a) To enable rathena.org functionality that helps you and your friends keep updated about what you’re doing within rAthena's Forums, e.g. notifying you and your rathena.org friends about your activity, your thoughts, problems, fixes, updates, releases, etc.
    • (b) To ensure that the forums are presented in the most effective manner for you and for your computer or other device from which you access the rAthena Forums.
    • (c) To provide you with information, products or services that you request from us and which we feel may interest you - in particular, we may send you newsletters or emails about rAthena's services (of course, it’s optional).
    • (d) To carry out our obligations arising from any contracts between you and us.
    • (e) To allow you to participate in interactive features of the rAthena Forums when you choose to do so.
    • (f) To notify you about changes to rAthena services.
    • (g) To improve or modify the rAthena Forums, for example based on which areas of the site you use the most and how you use them.
    • (h) To calculate conversion rates and other elements of rathena.org performance.
    • (i) In connection with the services of our Partners, such as payment processors, located in and outside the European Union, but only to the extent necessary to provide those services.
    • (j) to complete any required anti-money laundering or antifraud reviews required by applicable governments or authorities or applicable legal requirements and regulations on rAthena;

    8.2. We might share some aggregated and general nonpersonal data on user behaviour (e.g. sales per region) with third party partners who work with us to provide rAthena Forums services to you (for example, with developers/publishers/content creators selling packages on rathena.org or with payment providers) in order to support, improve or amend rAthena's Forum services or to help them to improve their products, which you have bought. We may also share non-personal information with data analysis services to help us run rathena.org.

  • HOW YOU USE YOUR INFORMATION

  • Please remember that any communications you have via rAthena (e.g. via private messages, forum topics, public/3rd party services, or other listings) may reveal your username/screen name, other details about you and the content of any communications by you with other users. Also, any information you post publicly using the rAthena Forums (e.g. your public profile) will be publicly available to rAthena users and others. We are not responsible for your use of otherwise private personal information, which you make available via rAthena's Forums, or the activities of other users or other third parties to whom you give or make available your information.

  • 9. THIRD PARTY INFORMATION COLLECTION AND EXTERNAL SERVICES

  • 9.1 rAthena may, from time to time, contain links to and from the websites or services of third parties (e.g. to developers or 3rd Party Service Providers). In addition, third parties (e.g. games developers/publishers) may also collect personally identifiable information (e.g. your email address or name) if you want to access additional game services, but they can collect any such information only after you have been informed of it and consented to it. This may include saving information to your rAthena Forums profile in relation to their services (such as, for example, providing feedback or reviews). Our Privacy Policy does not extend to these external sites or companies, so please refer directly to their privacy policies.

  • 10. OTHER STUFF

  • 10.1 Please be aware that we are subject to various laws and we may be required to release personal information to comply with law enforcement or other legal requirements.

    10.2 In the unlikely event of a reorganisation or merger of rAthena or rAthena accounts we may transfer personally identifiable information to an involved third party who will protect this to at least the same level as we do in this Privacy Policy.

  • 11. YOUR RIGHTS

  • 11.1 You have the right to withdraw your consent for processing of your personal information for marketing purposes at any time. You can change your email settings within your rAthena account and email communications from rAthena to you will contain an opt-out/unsubscribe option.

    11.2 Depending on where you live, you may have additional privacy rights. For example, in the EU you have the right to access information held about you and you may also contact us to request that we delete your personal information from our system; and you may have the legal right to ask us to rectify/correct your personal information if appropriate. We will use commercially reasonable efforts to honour your request, but we may decline requests that are unreasonably repetitive, are disproportionate or infringe the privacy of others. Of course, you will be notified in advance.

  • 12. CHANGES TO THIS PRIVACY POLICY

  • 12.1 We may change this Privacy Policy if we think it's necessary, e.g. for legal reasons or to reflect changes in rAthena's services. If so, we will make the changed Privacy Policy available online and (if you have an rAthena account) we'll email you to explain the changes. We will also update the “Last Updated” date.

    12.2 Once we change the Privacy Policy, it will become legally binding on you 30 days after we post it online. During that period, you're welcome to contact us if you have specific questions about the changes.

    12.3 If you don't agree to those changes (regardless of whether you email us), then unfortunately we must ask you to cease using rAthena's Forums. We're sorry we have to say that, but we hope you'll appreciate that for rAthena to work properly we need to have everyone using it under the same rules instead of different people having different rules. That's why we encourage you to get in contact if you have queries.

Sometimes we may have to share anonymised, non-personal information like operating system types in order to run other rAthena related services.

  • When you're using the rAthena Forums you can choose to share your own personal information with others (e.g. in topics/posts or private messages) but it's your responsibility.

     

     

     

  • 9. THIRD PARTY INFORMATION COLLECTION AND EXTERNAL SERVICES

  • You may find third party links in rAthena's Forums, or we might have to direct you to third parties (e.g. 3rd Party Services) so that you can get access to additional functionalities or features provided by them. They may collect information from you under their own privacy policies.

     

     

     

  • 10. OTHER STUFF

  • We might be required to comply with law enforcement requests.

    Your personal information will be protected the same way as it is right now, regardless of any reorganisations, acquisitions, etc. Fear not!

    We ask you to agree to changes to this Privacy Policy, otherwise unfortunately we have to ask you to stop using rAthena's Forums.
